GOWIN! SOFTWARE END-USER LICENSE AGREEMENT This End-User License Agreement ("Agreement") sets forth the terms and conditions of your download /installation/use of GoWin! Software (the "Service") including the demo/trial version and the licensed version. You should carefully read the following terms and conditions before using the software and its documentation. Use of the Service is contingent on your agreement to the following terms: 1. DISCLAIMER AND LIMITATION OF LIABILITY The Service, free or fee-based, is provided "AS-IS" without warranty of any kind. We do not warrant that the Service and the accompanying data are error free and do not warrant that it is fully compatible with all of your computer’s software. We assume no responsibility for the continuity, timeliness, completeness or for the mis-delivery because of any reason, in providing of any data for this software program or in performing of any required task. To the maximum extent permitted by law, we hereby further disclaim all warranties including, without limitations, any implied warranties of merchantability and noninfringement. The entire risk arising out of the use or performance of the Service remains with recipient. In no event shall any contributor to this Service be liable to any party for direct, indirect, special, or other consequential or incidental damages arising directly or indirectly from the use of the Service, including but not limited to any lost profits or any other pecuniary loss, loss of information, or business interruption, even if there has been prior advice regarding the possibility of such damages. The software and all information, data, and analytics provided through this service (the "Service") are strictly for informational and analytical purposes only. The Service does not provide financial, investment, or gambling advice. While we strive to ensure the reliability and accuracy of the data provided, we make no guarantees of specific outcomes, profits, or financial gains resulting from the use of this software. Users acknowledge that all past performance data is not a reliable indicator of future results, and the use of the Service involves inherent risk. REFUND POLICY Your satisfaction is our top priority. If you are not satisfied with our product for any reason, you may request a refund within 14 days of the purchase date. To initiate a refund, please contact our support team with your purchase details. 3. COPYRIGHT This software is protected by copyright laws and international copyright treaties. Purchase of the Service does not transfer any right, title, or interest in the Software or the underlying technology, except as specifically set forth in this Agreement. All titles and rights to this software product are exclusively owned by the author. You may not reverse engineer, decompile, or disassemble any part of this software product. You may be held responsible for any infringement of such rights or violations of this Agreement. 4. GRANT OF LICENSE This Agreement grants you a personal, non-exclusive, non-transferable, non-sublicensable limited license to use the Software Product as an end-user for non-commercial purposes. You are permitted to install the Software Product and use it on a single terminal connected to a single computer, for a single user, with only one installation active at any given time. You are not permitted to copy or modify this software program. You are not entitled to lease, rent, or lend the Software Product to any third party. The license is valid only within the country from which the order was placed. 5. LICENSE DELIVERY We reserve the right, at our sole discretion, to change the license delivery method, regardless of the initial selection. We shall not be held responsible for any non-delivery or mis-delivery arising from insufficient cooperation or any other reason, provided that a reasonable attempt to deliver the license has been made. Once delivered, or if a delivery failure is due to your fault, any subsequent delivery arrangements shall be at our discretion and may incur additional charges. We further reserve the right to refuse license delivery and refund the purchase price; however, any resulting refund fees shall be borne by you. 6. SUPPORT Neither the author nor any contributor to this software program is obligated to provide support or updates for the product. However, any support or updates provided shall be covered by this Agreement. Support is primarily offered through the software’s help file or via online tutorials. Additional support may be provided by email, strictly in English, and only for requests written in English. We reserve the right, at our sole discretion, to refuse such additional support, charge a fee for its provision, or require customer identification prior to providing assistance. 7. ACCOUNT CANCELLATION Any misuse of the Service, copyright infringement, violation of this Agreement, or any other breach of law will lead to account cancellation. Accounts may also be cancelled due to inactivity, in which case they will be considered abandoned. Circumstances that warrant immediate account cancellation include, but are not limited to: The use of anonymous proxies or any means of concealing your identity or real location; Failure to allow full tracking of your activity on our website and related services, as requested by us; Providing erroneous identification data or failing to verify your identity or physical address via our proposed methods; Multiple attempts to access the account with incorrect credentials or from different locations/connections; Accessing or attempting to access the account from more than one computer, more than one country, or using internet connections from different countries; Commercial use of products or services when the granted license is non-commercial. Upon account cancellation, all services provided to the customer will cease immediately. No refunds will be issued in such cases. 8. DISTRIBUTION No version of the Service—whether demo, trial, or licensed—may be sold, distributed, or modified in any way without prior written consent from the author. 9. GOVERNING LAW This Agreement is governed by the laws of the author's country of residence. Any disputes shall be settled exclusively in the judicial courts of the author's country of residence.
